Policies and Agreements

  1. Introduction

    Provider's Acceptable Use Policy is intended to help enhance the use of the Internet by preventing unacceptable use. All users of Provider's Internet services (the "Services") - those who access some of our Services but do not have accounts ("Visitors") as well as those who pay a monthly service fee to subscribe to the Services ("Clients") - must comply with this Acceptable Use Policy. We support the free flow of information and ideas over the Internet and do not actively monitor use of the Services under normal circumstances. Similarly, we do not exercise editorial control over the content of any website, electronic mail transmission, news group, or other material created or accessible over or through the Services, except for certain proprietary websites. However, in accordance with our Terms of Service Agreement, we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this Acceptable Use Policy.

    Under the terms of this agreement, your placement of information on dotPH's servers is an acknowledgement that you have read and understood this agreement, and that you agree to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, you should not proceed to place any information of any kind on dotPHs servers.


  2. Permitted CPU, Bandwidth and Disk Usage

    1. CPU and Disk Usage

      Use of hosting service space provided by dotPH is subject to the terms of this AUP. The Service at all times shall only be used for: (i) web files; (ii) active email; and (iii) content of User Websites.

      However, Shared hosting space may not be used for any activity not mentioned above, including but not limited to:

      • Storage of media, email archives, or other data as determined by the service providers
      • Offsite storage of electronic files, email or FTP hosts
      • Gaming server
      • To store over 100,000 files
      • Run MySQL queries longer than 15 seconds
      • Use more than 50% of your website’s disk space for storing emails use more than 50% of your website’s disk space for storing emails. Notwithstanding the above, your email storage cannot exceed 10 GB of disk space used by your Hosting plan limit, even if it is within the aforesaid 50% of your website’s disk space.
      • Use more than 5 GB or less based on the offering per database.
      • Consistent overuse of shared resources to the detriment of other Clients. (i.e. overdisk quota, exceeding monthly transfer limits, exceeding daily POP access)
      • Operating an open proxy server or using the Service as part of a proxy network
      • Sending massive emails more than 2,400 per day (100 per hour).
    2. Bandwidth Usage

      On shared hosting services, allotted limits for the bandwidth usage of each subscription have been mentioned on the product that client purchases, which include but are not limited to Shared Hosting, Email Hosting and VPS Dedicated Web Hosting Service. Thus, any website or client consuming bandwidth with more than 25% of the system resources for more than 90 seconds will be restricted.

      dotPH reserves the right to review and monitor every account in the shared hosting for excessive use of CPU, Bandwidth and Disk Usage which might affect the overall performance and stability of our servers, storage and networks.

      Should dotPH notice any violation on the permitted use of CPU, Bandwidth and Disk Usage, we may require the client to upgrade their current subscription to a higher plan, or move to a VPS/Dedicated Web Hosting Service, depending on the package that will suit the account’s requirements.


  3. Account Security and Company Systems

    1. dotPH requires Subscribers to be responsible for any actions made under their account. They must ensure that all the scripts/programs installed in their account are secure and permissions of directories are configured properly, regardless of the installation method. Moreover, clients are required to use a secure password. Audit may be done from time to time to prevent using weak passwords. Should a password have been identified as weak, the client's account will be at risk for suspension. dotPH will notify the client and allow them to update the password to a more strong and secure password.
    2. The Service and all related networks and systems access are provided only for authorized Clients. dotPH monitors the system, including without limitation, to facilitate protection against unauthorized access, and to authenticate operational security. Information may be duplicated, investigated and recorded for authorized purposes.
    3. Any account found connecting to a third party network or system without authorization from the third party is at risk for suspension. Access to networks or systems outside of clients direct management requires a written consent from the third party. dotPH, may, require documentation to confirm that the access is authorized.
    4. Any account found to be compromised will be suspended or terminated. The account will remain disabled should the client fail to clean-up after being notified of the ongoing issue. Upon request, dotPH may clean-up the account for the client with additional fee.
    5. dotPH reserves the right to migrate the account from one server/data-center to another to improve the service and in order to comply with applicable data center policies, local and foreign law or for technical or other reasons without prior notice.

  4. Compatibility with the Services

    1. By subscribing to dotPH services, the client is responsible to provide any equipment or software that may be necessary for the use of the service. In the event that the performance of any of our obligations under this Agreement may depend on clients performance, dotPH is not responsible for any delays due to clients failure to perform the obligations.
    2. dotPH at its sole discretion, may update hardware and software from time to time for the improvement of the service. Thus, the client is responsible for ensuring that all User Content and User Websites are compatible with the upgrade.
    3. Client is liable for the back up of all their User Content, including but not limited to, any User Website. In addition, dotPH does not guarantee the back-up of any User Content, and clients agree to accept the risk of loss of any and all User Content.

  5. Violations of AUP

    dotPH, at its sole discretion, shall determine whether an act constitutes a violation of the AUP. The list provided as part of the AUP is meant to serve as a guideline and not a complete enumeration of prohibited activities. The Client will notify dotPH to request permission prior to engaging in any activity which may impact the quality of service for other Clients.

    The following acts will be considered violations of the AUP:

    1. Illegal Use. dotPh expects all its clients to maintain responsible Internet behaviour and use the Service in accordance with the local and international laws. dotPH will not tolerate users that will be using the Service for illegal purposes (terrorism, piracy, prostitution, etc.) and will immediately terminate the Client's account without prior notice.
      To include:
      • Using the service in any way which violates Local or International law
      • Transmitting copyrighted material without authorization from the copyright holder
      • Violating export control regulations
    2. Malicious Activity
      To include:
      • Willfully interfering with the regular operation of the Service
      • Attempting to access any system which the Client knows or reasonably should know that the Client is not authorized to access in the manner or to the extent attempted
      • Hosting any deceptive material for the purposes of phishing
      • Running any password cracking software
      • Running root exploit kits against other servers
      • Distributing viruses, worms, or trojan horses
      • Forging or misrepresenting message headers in whole or in part
      • Scanning networks
      • Threatening or encouraging bodily harm or destruction of property
      • Violating of the rights of privacy or publicity of an individual
    3. Promotion of Illicit Activity.
      To include the promotion of:
      • Any activities prohibited by Local or International law
      • Any activities which result in the spread of computer viruses or other damaging programs or data files
      • Any activities which violate export restrictions (including making non-exportable information or software available to foreign nationals as may be prohibited by law)
      • Hacking
      • Gambling
      • Circumvention of copyright or patent protection
      • Exposure of any trade secret
    4. Unsolicited Bulk Electronic Mailing
      dotPH will not tolerate bulk electronic mailing or spam. dotPH tracks all mail activity going to and from its mail servers. Once a Client is identified to have been operating and sending mass mail / bulk mail, all the outgoing mail will be deleted from our mail servers. dotPH takes a firm stand in protecting its clients and the rest of the Internet community from online nuances such as spam and other malicious and unsolicited content. The Client's account may be terminated without prior notice.
      To include:
      • Transmitting any unsolicited commercial e-mail
      • Transmitting any unsolicited bulk e-mail

      The Client agrees to send bulk electronic mail only to those who have specifically requested to receive such mail and comply with all Local and International laws governing the transmission of electronic mail.

    5. Spamvertising and Related Activities
      To include:
      • Posting commercial, political, or advertising posts to public forums
      • Issuing unsolicited trackbacks for the purpose of promotion
      • Providing DNS resolution in support of Unsolicited Bulk Electronic Mailing
      • Hosting a destination site linked from Unsolicited Bulk Electronic Mailing
    6. Abuse
      dotPH maintains the highest level of performance on its servers. Clients who will exceed the allotted limits under their subscription plans will immediately be temporarily deactivated.This include, but not limited to the list mentioned on the Section 2. Permitted CPU, Bandwidth and Disk Usage of this AUP.
    7. Insufficiently-Secure Administration
      To include:
      • Use of a null password, dictionary word as password, or any other form of authentication lacking reasonable secrecy from a third party as part of a root or user-level authentication scheme
      • Allowing an unauthorized third party to establish root access and user-level access to Service provided by dotPH
      • Operating an open mail relay
    8. Proper Use
      Use of dotPH SMTP Servers is restricted to domains which are registered and hosted under the dotPH hosting service. This means that one cannot use domains other than their registered domain in their 'From:' or 'Reply To:' headers.

    Enforcement of AUP

    dotPH actively monitors usage of all its clients and reserves the right, at its sole discretion, to immediately suspend or terminate Service with or without notice to the Client.

    Furthermore, in the event that the Service is suspended, no refund shall be provided to the client.

    Reporting Violations of AUP

    If you believe that your account violated the AUP because of an attack
    If you believe you or your system was the subject of an attack originating from our network, contact us immediately by sending us an email at [email protected] or you may also reach us thru Zoom by clicking the "Talk Icon" in our website . All complaints will be investigated by our security response team.

    Revisions to AUP
    dotPH reserves the right to revise, amend, or modify this Acceptable Use Policy, our Terms of Service Agreement, our Privacy Policy and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with the Terms of Service Agreement.
